This is a clarification of the Lake Case Update published in our July-August issue of Living Power.
Status of Lake Case
The Plaintiffs in the Lake case have petitioned the North Carolina Supreme Court to review the decision of the Court of Appeals which held that the retirement health care promises made by the State of North Carolina do not constitute a binding contract. There is no timetable for the North Carolina Supreme Court’s decision to review the case, and if the review is granted there is no estimate of how long it will take to receive a final decision.
The Court of Appeals’ decision, as it currently stands, means that the State of North Carolina is free to change retirement benefits. However, there is currently no indication that there will be any significant changes in the plan in the near future.
